These Terms and Conditions (the "Terms") govern your use of Seaside Buddy (the "Service"), a subscription software service operated by Seaside Buddy (the "Company", "we", "us"). By creating an account, starting a free trial, or subscribing, you (the "Subscriber", "you") agree to these Terms. If you do not agree, do not use the Service.
Seaside Buddy is a hosted dashboard that helps content-driven consultants and small businesses track their content marketing from first impression to signed client, with an AI weekly summary and related features. The Service is provided on a subscription basis and is accessed online through your account. We may add, change, or remove features over time to improve the Service.
You sign in with your email address and a one-time code. You are responsible for keeping access to your email secure and for all activity under your account. One subscription is for one Subscriber. You may not share your account, resell access, or let others use it on your behalf. We may suspend or close an account we reasonably believe is being shared or misused.
New Subscribers may be offered a free trial (currently two weeks, unless a different trial is stated in the offer you accepted). During the trial you have access to the Service at no charge. If you do not continue to a paid subscription, your access ends when the trial ends. Founding-member and other special offers may carry different trial lengths and rates, as stated in the specific offer you accepted.
Paid plans are billed monthly or annually at the price shown at checkout. Payments are processed by our payment provider, Stripe. Your subscription renews automatically at the end of each billing period at the then-current price for your plan, until you cancel. By subscribing, you authorise us, through Stripe, to charge your payment method for each renewal.
We may change subscription prices. If a price change affects your plan, we will give you notice before it takes effect, and it will apply from your next renewal. If a payment is declined, we may suspend access until a valid payment method is provided.
You can cancel at any time from your account or by contacting us. When you cancel, your subscription stays active until the end of the period you have already paid for, and it does not renew after that. We do not provide partial refunds for the unused part of a billing period, except where required by law. Because a free trial lets you evaluate the Service before paying, fees already charged for a completed period are generally non-refundable, again except where required by law.
Some features use an AI provider (Anthropic's Claude). You provide your own AI provider API key. Anthropic bills you directly for your own AI usage; we do not mark it up and are not a party to your agreement with Anthropic. Your key is stored encrypted and used only to run the AI features in your own dashboard. You are responsible for keeping your key valid, for your usage and the costs Anthropic charges you, and for complying with Anthropic's terms. We are not responsible for AI provider charges, availability, or output.
You keep ownership of the data you enter, connect, or upload, such as your strategy, your metrics, and files you import. You grant us a limited licence to store and process that data solely to provide the Service to you. You are responsible for having the right to use any data you bring in, including data exported from third-party platforms. You can export or request deletion of your data as described in our Privacy Policy.
You agree not to misuse the Service. This includes not attempting to access other accounts or data, not reverse engineering or copying the Service, not reselling or sublicensing it, and not using it for anything unlawful. We may suspend or terminate access for a breach of these Terms.
The Service, including its software, dashboards, methodology, scoring, and prompts, is owned by the Company and is protected by law. We grant you a limited, non-exclusive, non-transferable, non-sublicensable right to use the Service while your subscription is active. No ownership or copyright in the Service is transferred to you. Content you create and data you bring in remain yours.
The Service is provided "as is" and "as available". We make reasonable efforts to keep it accurate and running, but we do not warrant that it will be uninterrupted, error free, or fit for a particular purpose. To the fullest extent permitted by law, the Company is not liable for indirect, incidental, special, or consequential damages, including lost profits or lost business. Where liability cannot be excluded, our total liability is limited to the amount you paid us in the three months before the claim.
Seaside Buddy is a measurement and decision tool. We do not guarantee any particular marketing, revenue, or business result from using it. Your results depend on your own content, market, and actions.
You may cancel at any time, as described in Section 5.
We may suspend or end your access immediately and without any refund if you breach these Terms or use the Service unlawfully.
If the Service is interrupted or discontinued for reasons outside our reasonable control, such as a provider outage or other events beyond us, we are not obliged to give a refund.
If we choose to discontinue or phase out the Service while you are on a paid term, and we cannot carry your subscription through to the end of that term, we will give reasonable notice and refund the unused, prepaid portion of your current period.
We may update these Terms as the Service evolves. If we make a material change, we will post the updated Terms here with a new date and, where appropriate, notify you. Continuing to use the Service after a change means you accept the updated Terms.
These Terms are governed by the laws of the State of Florida, USA. Any dispute that cannot be resolved between us will be handled first by good-faith discussion, then by mediation, and if still unresolved, by binding arbitration under the rules of the American Arbitration Association.
